Welcome to Homestead Produce. These Terms & Conditions ("Terms") govern your use of our website at homesteadproduce.farm, your purchase of our products, and your visit to our farm stand. By using our website, placing an order, or visiting our farm, you agree to these Terms. If you do not agree, please do not use our website or services.

Homestead Produce is a sole proprietorship located at 511291 Hwy 95, Bonners Ferry, Idaho 83805. In these Terms, "we," "our," and "us" refer to Homestead Produce, and "you" refers to the customer or visitor.

1. Eligibility

You must be at least 18 years old to place an order through our website. By placing an order, you confirm that you are 18 or older and that the information you provide is accurate.

2. Our Products

We sell pastured eggs, garlic, and other farm products. Please note the following about our products:

  • Eggs are sold ungraded under Idaho's farm-direct exemption. They are sold refrigerated and need to be refrigerated.

  • All produce is grown or raised on our farm and sold in season. Availability, size, color, and appearance will vary naturally.

  • Photos on the website are representative. Actual products may differ in appearance.

Food safety notice: As with any fresh agricultural product, please handle, store, and cook our products properly. Consuming raw or undercooked eggs or other raw foods may increase the risk of foodborne illness, especially for young children, older adults, pregnant individuals, and people with weakened immune systems.

3. Orders, Pricing, and Payment

Placing an order. Orders may be placed through our website at homesteadproduce.farm. When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order, for example if a product is out of stock, if there is a pricing error, or if we are unable to fulfill the order for any other reason.

Pricing. All prices are listed in U.S. dollars and are subject to change without notice. We make every effort to ensure pricing is accurate, but if a pricing error occurs, we will contact you before processing the order and you may choose to confirm the order at the corrected price or cancel.

Payment. Online payments are processed securely through Squarespace Payments and Square. We do not see or store your full credit or debit card information. By placing an order, you authorize the charge to your selected payment method.

Taxes. Applicable sales taxes, if any, will be added at checkout.

4. Shipping and Pickup

Shipping (garlic and shelf-stable items only). We ship within the United States via USPS. We do not ship eggs or perishable items. Shipping costs are displayed at checkout. Once a package is handed off to USPS, delivery times and conditions are outside our control.

Risk of loss. Risk of loss for shipped items passes to you upon delivery by USPS to the address you provided. If a package is lost or damaged in transit, please contact us so we can help resolve it.

Farm stand pickup. Orders designated for pickup may be collected at our farm stand during open hours (currently Monday–Saturday, 10 a.m. – 5 p.m., closed holidays). Unclaimed pickup orders will be held for 7 days. If you have not picked up your order within 7 days and have not made other arrangements with us, the items may be restocked and your order may be cancelled without a refund. If you need more time, please contact us.

5. Returns, Refunds, and Cancellations

Because we sell perishable agricultural products, we generally do not accept returns. However:

  • Cancellations. If you need to cancel an order before it has shipped or before pickup, please contact us as soon as possible and we'll do our best to accommodate you.

  • Refunds. If you are unsatisfied with your purchase, or if there is a problem with quality, condition, or shipping, please contact us within a reasonable time (ideally within 48 hours of receipt or pickup) and we will work with you to make it right. Refunds are issued at our discretion and may be full or partial depending on the situation.

  • Shipping damage. If a shipped item arrives damaged, please save the packaging and contact us promptly so we can address it and, where appropriate, file a USPS claim.

6. Farm Stand and On-Farm Visits

Our farm stand is open to the public during posted hours. When visiting, please keep in mind:

  • Children must be supervised by an adult at all times.

  • Pets should be leashed and kept under control.

  • Please stay out of fenced areas, livestock enclosures, and areas with equipment.

  • Common sense and courtesy are appreciated.

Idaho Agritourism Notice. A working farm involves inherent risks, including but not limited to uneven ground, livestock, equipment, weather, and natural conditions. Under Idaho Code §6-3001 through §6-3005, there is no liability for an injury to or death of a participant in an agritourism activity that results from the inherent risks of the activity. By visiting our farm, you acknowledge and assume these inherent risks. The required statutory warning is posted at the farm stand.

7. Newsletter and Email Communications

By subscribing to our newsletter, you agree to receive emails about farm updates, product availability, seasonal information, and event invitations. You can unsubscribe at any time using the link at the bottom of any newsletter. We do not sell or share your email address with outside companies. 8. Website Use and Intellectual Property

All content on homesteadproduce.farm — including text, photographs, logos, graphics, and design — is owned by Homestead Produce or used with permission and is protected by copyright and other intellectual property laws. You may view and share our content for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or use our content for commercial purposes without our prior written permission.

You agree not to use our website in any way that:

  • Violates any applicable law or regulation

  • Interferes with the operation of the website or its security

  • Attempts to gain unauthorized access to any part of the website, our systems, or other users' information

  • Uses automated tools to scrape, copy, or harvest content

9. Disclaimers and Limitation of Liability

Products sold "as is." Our products are sold as-is, as fresh agricultural goods from a small family farm. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose, except where such warranties cannot be excluded under applicable law.

Website availability. We make reasonable efforts to keep our website accurate and available, but we do not guarantee it will be uninterrupted, error-free, or free of viruses or harmful components. Information on the website is provided for general purposes and may not always be current.

Limitation of liability. To the fullest extent permitted by law, Homestead Produce's total liability arising out of or related to any product purchase, website use, or farm visit shall not exceed the amount you paid for the product or service giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages.

Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be waived.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Idaho, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms, your purchase, or your visit to our farm shall be resolved exclusively in the state or federal courts located in Boundary County or Kootenai County, Idaho, and you consent to the jurisdiction of those courts.

If any part of these Terms is found to be unenforceable, the remaining provisions will continue to apply.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we'll change the "Last updated" date at the top of this page. Your continued use of our website or services after a change means you accept the updated Terms.
